Subjects of policy advice and legislation drafting

Policy advice and assistance for the drafting of legislation is very often an important part of technical assistance projects carried out by ADT Projekt GmbH. Assistance has been provided in the fields of

Methodology for legislation drafting

Technical Assistance on the drafting of legislation, especially in the framework of EU funded projects may follow the following procedure:

• Assessment of the legal framework including the constitution and major gaps
• Provision and partly translation of EU legal text that are relevant as a source for the drafting of the relevant legislation
• Drafting of the legal document
• Preparation of a table of concordance, showing the degree of compliance of the legal texts to the relevant EU legal source text; in case of non-compliance a justification for non-compliance shall be given and an outlook in which steps and when harmonization will be achieved
• Clarification on terminology and spellings in the relevant language and the English language of the European Union
• Clarification of validation and notarization of relevant language versions according to the relevant Constitution and the legal framework
• Each draft legal text completed shall be established in English and the relevant national language accompanied by tables of concordance, a technical report and an impact assessment
